Agreement

These terms govern your use of software and services provided by Engstrom Software LLC, an Oklahoma limited liability company. By creating an account or using our applications you agree to them.

Your account

You are responsible for keeping your login credentials confidential and for activity that occurs under your account. You must provide accurate information when registering and keep it current.

Subscriptions and billing

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, and are subject to those stores' terms in addition to these.

Subscriptions renew automatically until cancelled. You can cancel at any time through your store's subscription settings; cancellation stops future renewals and access continues until the end of the paid period. Where a free trial is offered, it converts to a paid subscription unless cancelled before the trial ends. Refunds are handled by the store you purchased through, according to their policies.

Acceptable use

You agree not to:

• Use the services for any unlawful purpose
• Attempt to gain unauthorised access to our systems or another user's data
• Reverse engineer, resell or redistribute the software
• Interfere with or place unreasonable load on the services

Important limitations — please read

Our applications are planning and information tools. They do not replace, and must not be relied upon in place of:

• Your electronic logging device or official hours-of-service record
• Your carrier's policies and instructions
• Posted road signage, clearance heights, weight limits and restrictions
• Applicable federal, state, provincial and local regulations

Estimated arrival times, hours calculations, routing, toll costs, weight checks and similar outputs are estimates based on the information provided and on third-party data. Conditions change, data can be incomplete or out of date, and results may be inaccurate.

You remain solely responsible for the safe and lawful operation of your vehicle, including verifying clearances, weights, routing legality and your available hours before and during any trip.

Where an application offers the option to open a route in a third-party navigation application, those applications may provide routing intended for passenger vehicles and may not account for vehicle height, weight or hazardous materials restrictions. Use of such third-party applications is at your own risk.

Availability

We aim to keep the services available but do not guarantee uninterrupted operation. Features depend in part on third-party services and may change or be discontinued.

Disclaimer of warranties

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Engstrom Software LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, missed deliveries, fines, penalties or citations arising from your use of the services. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

Termination

You may stop using the services and delete your account at any time. We may suspend or terminate access if these terms are breached.

Governing law

These terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.

Changes

We may update these terms. The date at the top of this page reflects the most recent version, and continued use after changes constitutes acceptance.
